Abstract
This thesis research is motivated by the existence of a decision regarding marriage dispensation caused by marriages under the marriage age limit that has not been reviewed with the maslahah mursalah approach. Therefore, this thesis research aims to determine what matters are considered by the judge in granting decision Number 0098/Pdt.P/2023/PA.Bks regarding marriage dispensation and review the suitability of the decision with the concept of maslahah mursalah. This research uses a mixed method, namely a normative and empirical approach. The normative approach is carried out through a study of laws and regulations, court decisions, and related legal literature. Meanwhile, the empirical approach is carried out through interviews with judges of the Bekasi Religious Court. Data analysis is carried out qualitatively by connecting legal facts and relevant theories. The results of the study indicate that the judge's considerations in granting marriage dispensation are based on the empirical conditions of the parties, such as the existence of urgent circumstances, the readiness of the prospective husband, and efforts to avoid greater harm. From a maslahah mursalah perspective, the ruling reflects an effort to achieve public welfare, particularly in safeguarding honor and progeny, while preventing worse social impacts. Therefore, the granting of marriage dispensation in the ruling is justifiable as long as it remains case-specific and does not become a common practice.
