Abstract
This study aims to analyze the legal considerations (ratio decidendi) of the Panel of Judges of the Bekasi Religious Court in Decision Number 0356/Pdt.P/2024/PA.Bks regarding the application of wajibah wills in inheritance cases containing elements of munasakhah and religious differences, and to assess its legal implications on the distribution of heirs' shares. The research method used is normative legal research with a case approach and a statute approach, supported by a literature study of the Compilation of Islamic Law, laws and regulations, legal doctrines, and Islamic legal literature, as well as an analysis of court decisions as the main data sources. The results of the study indicate that the Panel of Judges progressively uses the mandatory will construction as a legal instrument to provide a share to parties prevented from inheriting due to religious differences within the munasakhah structure, while adhering to Articles 171, 174, 185, and 209 of the Compilation of Islamic Law, thus achieving a balance between legal certainty, justice, and public welfare, particularly in protecting the rights of underage successor heirs without disregarding the familial relationships of non-Muslim parties.
