Abstract
This thesis research aims to find out the differences or similarities in the concept of determining the rights and levels of wife's maintenance between KHI and Imam An-Nawawi's opinion in the book al-Majmu' Syarah al-Muhadzdzab. This research uses qualitative research methods, is a type of normative qualitative research or library research, with a normative juridical approach and character studies. The primary data source used is the book al-Majmu' Syarah al-Muhadzdzab. The research that has been done obtained the results that the right of maintenance of a wife who has given herself to her husband, then must be supported. However, the level of nafkah is adjusted to the husband's condition. In al-Majmu', the wife's right to maintenance is regulated in several articles that consider various obstacles that can prevent the wife from receiving maintenance from the husband. There are five points of similarity between KHI and al-Majmu' regarding the concept of wife's maintenance, as well as four points of difference between the two concepts. The similarities are the obligation to provide maintenance in the form of clothing, food, shelter, household expenses, care expenses, medical expenses, and education for children. The difference lies in the background of the time of determination and the standard or provisions of the level of nafkah given to the wife according to the husband's condition.
